If you are named in a listing and want it corrected or removed, email hello@upstudio.art.
We may also collect other information not specifically listed here, which we will use as described in this policy or as disclosed to you at the time of collection.
How we use your information
Upstudio's primary purpose in collecting personal information is to provide the services that you request. Any of the personal information we collect may also be used for the following purposes or as otherwise described in this Privacy Policy or at the time of collection:
To provide our products and services. We use personal information to provide our products and services, including to:
-
Deliver the services and products that you purchase from us.
-
Process your transactions and manage your subscriptions.
-
Personalize your experience, respond to your individual needs, verify your identity, or determine your eligibility for offers and promotions.
-
Establish, manage, monitor, and maintain your Account.
-
Communicate with you about order updates, changes to our Platform, and other service-related communications and alerts.
-
Provide customer support and troubleshooting.
-
Fulfill any purpose for which you provide the personal information.
For research and development. We use personal information for research and development purposes, including to understand and analyze the usage trends and preferences of our customers, to make our Platform and other offerings better, to improve our customer service and more effectively respond to customer service requests and support needs, and to improve and develop new features, services, products, and functionality. We also continually strive to improve our website offerings based on the information and feedback we receive from you.
As part of these activities, we may create aggregated, de-identified, or other anonymous data from personal information we collect. We may use this anonymous or de-identified data and share it with third parties for our lawful business purposes.
To send our newsletter. We may send you direct marketing communications related to our business or other products and services you may be interested in as permitted by law. You may opt-out of our marketing communications as described in the "Your Choices" section below.
To comply with laws and regulations. We will use personal information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.
For compliance, fraud prevention, and safety. We may use personal information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to: (a) maintain the safety, security, and integrity of the products and Platform, business, databases, and other technology assets; (b) protect our, your, or others' rights, privacy, safety or property (including by making and defending legal claims); (c) audit our internal processes for compliance with legal and contractual requirements and internal policies; (d) enforce the terms and conditions that govern the Platform; and (e) prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.
With your consent. We will disclose your personal information in accordance with your prior direction or, in some cases, we may specifically ask you for your consent to collect, use, or share your personal information, such as when required by law.
AI processing
When you use a feature that generates text, we send the relevant portion of your data to a third-party AI provider so it can produce the output you asked for.
-
We send only what the feature requires, not your whole account.
-
Our AI providers operate under commercial terms that prohibit using your inputs to train their models.
-
Generated output is returned to your account and stored with your other records.
What Information We Share With Others
We may share your personal information with the following entities or persons:
With our service providers. We may share your personal information with third parties who perform services on our behalf or assist us with the orderly operation of our business. They are the platforms we use for customer service, our newsletter and email, and payment processing where we control the information and use their services for those specific tasks. We also work with service providers that help us perform website hosting, maintenance services, database management, analytics, fraud protection, marketing, customer relationship management, finances, and other purposes.
When you ask us to. Sharing a portfolio or proposal with someone you choose.
When the law requires it. We may access, preserve, and disclose your information if we reasonably believe it is necessary to comply with a subpoena, court order, or other legal process, to enforce our Terms, to respond to a claim that your content infringes someone's rights, or to protect the rights, property, or safety of you, other users, or the public. Where we are permitted to tell you first, we will.
If the business changes hands. If Upstudio is acquired, merged, reorganised, or its assets are sold, your information may transfer as part of that. Any acquirer will be bound by the commitments in this policy and in section 5 of the Terms, including that your work is yours and is not used promotionally without your opt-in. We will notify you before any such transfer takes effect.
We do not sell your personal information, and we do not give, barter, exchange, or rent it to third parties. Sharing information with the service providers described above, so that they can perform services for us, is not a sale.
Where your data is stored
Upstudio is based in the United States and your data is processed there. Some of the companies we rely on operate in other countries, which means your information may be handled outside the United States under laws that differ from your own.
Retention and deletion
Upstudio retains personal information for as long as necessary to operate and support the services, including complying with legal and accounting obligations, resolving disputes, and enforcing our agreements.
Some information may be retained for extended periods or indefinitely, particularly where it forms part of the historical record required for operational, legal, or archival purposes.
Requests for deletion of personal information are subject to these retention requirements and applicable legal obligations.
Cookies
We use cookies that are strictly necessary to run the service:
-
Authentication cookies keep you signed in.
-
Security cookies protect against request forgery and abuse.
These cannot be turned off without breaking the application, and they do not track you across other websites.
The usage and technical information described under “Information collected automatically” above, such as pages viewed, session duration, referring site, access times, and IP address, is recorded in our server and hosting logs as a normal part of delivering the service. It is not gathered by analytics or tracking cookies, and it is not used to follow you across other websites.
We do not use advertising cookies and we do not permit third-party ad networks on Upstudio.
Do Not Track. Some browsers can send a "Do Not Track" signal. There is no agreed standard for how services should respond to it, and Upstudio does not currently respond to it. Since we do not track you across other websites, there is nothing for the signal to switch off.
Security
We implement reasonable security measures designed to maintain the safety of your personal information. Account passwords are stored in hashed form and are not accessible to us in readable form.
Despite reasonable efforts to protect your personal information, we cannot guarantee the security of your personal information. No method of transmission over the Internet, or method of electronic storage, is fully secure.
Your choices and rights
Access and deletion. You can request access to or deletion of all personal information we have on you at any time by contacting hello@upstudio.art
Opt out. You may opt-out of marketing-related emails by clicking the “unsubscribe” link at the bottom of the email or by contacting us as described below. You may still receive service-related communications, such as those about your Account, or we may deliver notifications directly to you through the Platform.
Cookies. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Platform and our Site may not work properly.
California residents. If you are a California resident, you have the right to know what personal information we collect, to request deletion, to request correction, and not to be discriminated against for exercising these rights. We do not sell personal information or share it for cross-context behavioural advertising. To exercise these rights, email hello@upstudio.art. We will verify your request through the email address on your account.
California, Shine the Light. California residents may ask what categories of personal information we shared with third parties for those third parties' own direct marketing. We share nothing for that purpose, so the answer is none. If you would like that confirmed in writing, email hello@upstudio.art with "Shine the Light" in the subject line.
Nevada. Nevada residents may opt out of the sale of certain personal information. We do not sell personal information. If you would like your opt-out recorded in case that ever changes, email us.
Other United States states. Residents of states with comprehensive privacy laws have similar rights. The same email address handles all such requests.
Children
Upstudio is not intended for anyone under 18 and we do not knowingly collect personal information from children. If you believe a child has provided us with information, email hello@upstudio.art and we will delete it.
Third-party links
Upstudio may link to external sites, including open calls, galleries, and marketplaces. We do not control those sites and this policy does not apply to them.
Changes to this policy
We may update this policy. If a change is material, we will notify you by email or in the product before it takes effect, and update the version history below.
Terms of Service
Our Terms of Service set out the agreement governing your use of Upstudio, including ownership of your work, disclaimers, and limitations of liability. This policy forms part of it.
